TPC Explosion Litigation Client Update | May 2021

The Multi-District Litigation Panel ordered all TPC cases to be coordinated for pre-trial discovery before the Honorable Courtney Arkeen of the 128th Judicial District of Orange, Texas.

Judge Arkeen held a formal hearing on Monday, May 5, 2021. The parties updated the Judge on the status of the litigation. The Plaintiffs have added new Defendants to the litigation, including investors for TPC, Nalco, and Ingenero. The Plaintiffs are in the process of serving the new Defendants with the lawsuit. We believe the evidence shows these companies have liability for the explosion that occurred at the TPC plant. At this time, we do not anticipate adding any additional Defendants to the litigation. Once the new Defendants have filed an Answer, we will enter into a new, and hopefully final, Scheduling Order with the court and liability discovery will begin.

We continue to explore settlement possibilities and will keep clients updated as settlement discussions progress. If these discussions lead to settlement offers, we will be contacting clients to discuss the offer and make recommendations.

The next status hearing will be conducted on June 7, 2021. After the next hearing, we will be sending another update of the litigation.
