The Multi-District Litigation Panel ordered all TPC cases to be coordinated for pre-trial discovery before the Honorable Courtney Arkeen of the 128th Judicial District of Orange, Texas.
Judge Arkeen held a formal hearing on Monday, April 5, 2021. The parties updated the Judge on the status of the litigation. We continue to review documents and have conducted two depositions of TPC representatives to help identify other potential parties. While our investigation and review of the evidence continues, we have identified at least two companies that need to be added to the litigation. We believe the evidence shows these companies have liability for the explosion that occurred at the TPC plant. At the hearing, we informed the Court that these parties would be joined into the litigation by the end of this month.
We are still waiting for the TPC attorneys to formally respond with an offer of settlement. We will keep clients updated as settlement discussions progress.
The next status hearing will be conducted on May 3, 2021. The purpose of the conference is to receive updates on the progress of the litigation, resolve any pre-trial disputes, and keep the litigation moving toward completion. After the next hearing, we will post another update of the litigation.
